1. Agreeing to these terms
Using WelcomeBird means accepting these terms. If you do not accept them, do not use it. If you have already started, you can stop at any time and ask us to delete your account.
WelcomeBird is made and run by MAROTECH SOLUTIONS (Registration no. 202603017053 (CT0159782-U)), Kuala Terengganu, Malaysia. In these terms, "we" and "us" means MAROTECH SOLUTIONS, "WelcomeBird" means the owner app, the web dashboard at app.welcomebird.com, the booking pages and the service behind them, and "you" means the person who signs up and the business they sign up for.
2. What WelcomeBird is
WelcomeBird gives your business its own online booking page, sends confirmations and reminders to your customers, and gives you and your team an app to run the day: the calendar, bookings, check-in, ratings and loyalty points.
What it does will change. We add, change and sometimes remove features. Where a change takes away something you rely on, we will tell you first.
3. Your account
You must be 18 or older to create an account or run a business on WelcomeBird. Give an email address and phone number that are really yours, keep your password to yourself, and tell us straight away if you think someone else has got into your account.
What happens under your account is treated as done by you. If you add staff or admins, you are responsible for who you add and for removing people who should no longer have access.
4. Your business and your customers
When customers book with your business, the details they give (their name, phone number, email, notes, bookings, ratings and loyalty points) belong to your business's relationship with them. Your business decides why that data is collected and what it is used for. We store and process it for you so the service can work, and we do not use it for anything else.
That makes your business responsible, under Malaysia's Personal Data Protection Act 2010, for having a good reason to hold your customers' data and for answering their requests about it. We help: our privacy policy explains what we do with it, and you can point customers to it.
You are responsible for what you offer and promise on your booking page: your services, prices, opening hours, deposits, cancellation rules and the service itself. Disputes between you and your customers are between you and them.
5. Messages to your customers
WelcomeBird sends booking messages for you: phone codes, confirmations, changes, reminders and, when you turn them on, rating requests. They go by WhatsApp, SMS and email, depending on your settings and your plan.
These messages are about bookings your customers made. You must not use WelcomeBird to send advertising to people who did not ask for it. Offer messages go only to customers who said yes to them.
WhatsApp, SMS and email depend on other networks. We cannot promise every message arrives, or arrives on time. Do not rely on a reminder alone for anything urgent or medical.
6. What you must not do
- Break the law with WelcomeBird, or help someone else break it.
- Send spam, or use booking reminders, rating requests or offers to message people who did not book with you or did not agree.
- Make fake bookings, fake ratings or fake reviews, or book slots you do not mean to use to block other people.
- Take bookings for anything illegal, or put content on your booking page that is false, hateful, or that infringes someone else's rights.
- Try to reach an account, a business or data that is not yours.
- Probe, scan, overload or interfere with the service, or get around a limit of your plan.
- Copy, resell or rebuild WelcomeBird, except where the law allows it whatever these terms say.
Finding a security problem and telling us about it is not on that list. Write to us and we will thank you properly.
7. Plans, payments and refunds
WelcomeBird has a Free plan and paid plans. Current prices and what each plan includes are on our pricing page. Prices are in Malaysian ringgit.
Every new business gets a free trial of a paid plan, without a card. When the trial ends, your business moves to Free unless you buy a plan. Nothing is deleted when that happens.
You buy plans and message credit packs on the web dashboard. Payments are handled by Stripe, by card or FPX online banking. We never see your full card number or your bank login.
Plans do not renew on their own at the moment. When automatic renewal is added, we will tell you before it applies to you.
Top-up message credits never expire. Your plan's monthly credits start again each month and do not carry over.
We refund a payment in full, without you asking, when it arrives after your plan was already paid for, when it does not match what the payment page asked for, when it is a second payment by mistake, or when it is for a business that was deleted before the payment arrived. Other payments are not refundable, except where Malaysian consumer law says otherwise.
8. What you put in stays yours
Your business details, photos, services, prices and your customers' data are yours or your business's. We do not claim ownership of any of it.
To run the service we need your permission to store it, back it up, show your booking page to the public, and pass the details a message needs to the providers that deliver it. That permission is only for running WelcomeBird for you. It lasts while your account exists, and it does not let us sell your data, show it to anyone else, or use it to advertise.
9. What is ours
WelcomeBird itself, its software, name, logo, design and words, belongs to us. Using it gives you permission to use it for your business, and nothing more. Using the WelcomeBird name or logo outside the service needs our written permission.
10. Service availability
We work to keep WelcomeBird running and your data safe, but we cannot promise it will always be available or free of faults. We may take it offline for maintenance, and things outside our control can interrupt it, such as network, hosting or messaging provider outages.
Keep your own record of anything that matters, such as tomorrow's bookings.
11. Our liability
WelcomeBird is provided as it is. As far as the law allows, we are not liable for indirect or consequential loss, lost profit, lost bookings or lost data, or for a decision you made based on what WelcomeBird showed.
As far as the law allows, our total liability to you for any claim about WelcomeBird is limited to what you paid us in the 12 months before the claim.
Nothing here limits liability that cannot lawfully be limited. Your rights as a consumer under Malaysian law stand, whatever this section says.
12. Ending it
You can stop using WelcomeBird at any time. To delete your account, see Delete your account.
We may suspend or close an account that breaks these terms, or that is used in a way that puts the service, other businesses or customers at risk. Where it is reasonable to warn you first, we will.
13. Privacy
What we collect, why, and who else sees it is set out in our privacy policy, which is part of these terms.
14. The app stores
If you install the WelcomeBird app from the App Store or Google Play, that store's own terms apply to the installation too. These terms are between you and us. Apple and Google are not part of them, and neither is responsible for the app or for supporting it.
15. Which law applies
Malaysian law governs these terms, and the courts of Malaysia decide any dispute about them.
16. Changes to these terms
When these terms change, the date at the top changes too. If a change matters to how you use WelcomeBird, we will tell you by email or in the app before it takes effect. Using WelcomeBird after that means you accept the new terms.
